Have a DUI(fr-44), insurance premium is $2,800. Am I doomed to never drive again?

After moving to Florida from Virginia my premium almost tripled (went from paying about $280 a month to being charged $680 a month). I have to hold my car insurance coverage for another 20 months before my fr-44 expires but there’s no way I can afford it especially now that I’m about to start college. I’d need a full time job to keep up with tuition + my car insurance. I’m kind of freaking out right now, any advice?

Life is “one big hassle” after a DUI conviction. In Florida and Virginia, the FR44 form provides proof of mandatory auto insurance. Many companies do not file (submit) form FR44 to State authorities electronically at point of sale. Buying a policy from a company that expedites the process is helpful to drivers seeking license reinstatement. Some companies discourage applicants with a DUI.

The first offense of DUI in Florida results in license revocation for 180 days up to one year. In Virginia, a yearlong suspension is mandatory. DUI school attendance and completion, along with treatment if referred, is required. Increased insurance coverage is mandated. The cost for a policy skyrockets. There are fines and fees to pay. Social stigma can take its toll too. Subsequent offenses are, naturally, more severe. Fast, efficient filing of form FR44 is a relief to anyone experiencing a DUI conviction.

After a policy becomes effective, a driver should be able to receive license reinstatement immediately. The FR44 form (certificate) with its increased liability insurance requirement replaced the SR22 certificate (DUI cases only) in 2008. In Virginia the increased liability limits evidenced by FR44 is double the SR22 limits. In Florida, the additional coverage is ten times. Failure to maintain FR44 auto insurance during the compliance period (three years) will result in license and vehicle registration suspension. Other states will likely follow Florida and Virginia.

Life is full of challenges and unexpected obstacles. Form FR44 does not have to be one of them. Choose a company that files instantly in order to reinstate your license quickly.

FR44 insurance requirements

Required liability limits are 100,000 of bodily injury for each person with 300,000 available per accident and 50,000 of property damage per accident. A total combined single limit, i.e. for bodily injury and property damage, of 350,000 also satisfies the requirement. These amounts are ten times what the State considers as being financially responsible for drivers without a DUI.

FR44 insurance cost

The filing (submission) fee for the FR44 form is 15.00 dollars. Other insurance related costs for the DUI driver are significantly more. Additional liability coverage, removal of safe driver discounts, and placement into a less favorable tier (category) with higher premium (rates) can be expected.

FR44 form completion

Insured person information required is name, address, driver license number, and birth date. Insured company information required is name, NAIC code, policy number, FR44 case number, and certification effective date. Additional information indicates which type of two policies is selected. An owner’s policy with year, make model and VIN of all vehicles registered and insured. Or an operator’s policy applicable to any vehicle not registered or titled to the listed person. Authorized representative signature and date prepared completes form FR44.

FR44 filing

The completed form is filed (submitted) to Florida’s Bureau of Financial Responsibility. After June 30, 2009 all insurance companies must report FR44 filings to the state electronically. The DMV does not accept Proof of FR44 insurance from DUI drivers. Companies are required to notify the bureau if an FR44 insurance policy is canceled, terminated, or lapses for any reason.

Miscellaneous FR44 facts

The actual name of the form is the Florida Uniform Financial Responsibility Certificate FR-44. Florida statute 324.023 addresses the FR44 and is applicable after October 1, 2007. Compliance period is for three years. There are no driving restrictions associated with the FR44 filing. Non compliance results in license and vehicle registration suspension. FR44 filing must be on a Florida auto insurance policy. There can not be more than one FR44 or an FR44 and SR22 on the same driver.

Let me first start by defining what a Florida FR-44 and SR-22 are and then we can decide which one you really need. If you got a DUI in the state of Florida most likely you need to file either an FR-44 or SR-22.

An SR-22 is a form used by insurance companies to ensure the driver is meeting state liability limits. Florida auto insurance companies submit this form electronically to Florida’s Bureau of Financial Responsibility for those drivers that are mandated to submit this proof of insurance. The state requires you to carry minimum liability limits of $10k in bodily injury per person and $10k in property damage. Drivers who are required to carry an SR-22 generally pay more due to the nature of the traffic violation. In addition to the extra premium for the offense you will also pay a $15 filing fee to submit the SR-22.

The state of Florida may also require you to file an FR-44 which is similar to an SR-22 only it has higher minimum liability requirements. The minimum liability requirements are ten times that of the states minimum requirements at $100k per person and $50k property damage. The cost to file the FR-44 is $15 just like the SR-22 but your overall cost to get insured will increase due to the nature of the traffic violation and the increased liability limits. This form is referred to as Florida Uniform Financial Responsibility Certificate FR-44 or just FR-44 for short. You must maintain this filing for three years but there are no driving restrictions associated with the FR-44.

Now that we understand what each type of form is and the requirements each possess let’s look at which one you need if you are convicted of a DUI in Florida. Effective October 1, 2007 Florida Statutes increased the required liability insurance for bodily injury in those circumstances where a person has been convicted of driving under the influence. Basically if you have been convicted of a DUI after such stated date you will need to file an FR-44 Form instead of an SR-22. The only difference between the two forms is if you were convicted of a DUI in the state of Florida it now requires higher liability limits on your auto policy.

A DUI charge can be very serious and include large fines, jail time, or both. In Florida, the drunk driving laws are very strict and so are the penalties. Depending on the situation, a DUI can be considered a misdemeanor or a felony, if it is a felony it will show up on your criminal record. If this happens, anyone running a background check on you can see the charge, including employers. Some parts of Florida have especially strict fines. In Orlando it is rare to see someone get convicted of a DUI and get out of it without paying at least $5000 in fines, expenses, and surcharges.

The penalties of a DUI charge depend on prior charges. Due to the criminal law in Orlando, a first conviction costs nothing less than $500 and 50 hours of community service, or another $500. This is without calculating expenses related to probation, mandatory classes, insurance charged, and DMV fees. These expenses can add hundreds more to your total cost. A second conviction is nothing less than $1000 and mandatory imprisonment of at least ten days. If convicted for a second or third DUI it can then become a felony, which would negatively affect your whole life. A third conviction costs nothing less than $2000 and mandatory imprisonment for at least thirty days. This is very serious and can cause you to lose your license forever. On top of all these fines, fees, and surcharges comes the loss of money from missing work, transportation, and career values. If you are young and looking into education institutions, this is especially bad.

If you do happen to end up in a DUI charge in Orlando, be sure to contact a drunk driving attorney, they may cut down the charges, cost, and even time of DUI penalties. An experienced criminal defense lawyer has dealt with drunk driving cases many times before and knows the laws in and out. Don’t let the penalties of a DUI charge compound over time, you must act right away. Finding a good DUI lawyer may require some time and research but will save you a lot of time and money in the long run. Although Florida’s DUI laws seem specifically harsh, other states are not much more lenient. A DUI charge is hard to deal with no matter where you, make sure you get the appropriate help.

You should contact an Orlando DUI lawyer as soon as possible if you get hit with a drunk-driving charge. Keep your license. Keep your mobility. Keep your cash.

SR-22 is not a type of Florida auto insurance. It is the name of the form used by auto insurance companies to certify compliance for persons required to maintain minimum limits of liability insurance. The Sr-22 form is submitted by auto insurance companies to the Florida Bureau of Financial Responsibility for policyholders who are mandated to submit proof of liability insurance.

For most residents the minimum mandatory Florida car insurance, as indicated in the Florida No Fault Law, is $10,000 of Personal Injury Protection and $10,000 of Property Damage Liability. Bodily Injury Liability, indicated on an SR-22, in addition to the No Fault Law requirement is for persons who meet certain criteria. Drivers who have caused injuries or received certain traffic violations, such as, driving under the influence, or suspension for too many points may require an SR-22.

Minimum Bodily Injury Liability limits to be in compliance with a Florida SR-22 are $10,000 per person and $20,000 per accident. A combined single limit of liability in the amount of $30,000 would also fulfill the SR-22 requirement. As of October 1, 2007 a driver convicted of operating a vehicle under the influence (DUI) will be required to secure higher limits and submit proof via an FR44 filing not an SR22.

The premium for Bodily Injury Liability insurance is the same from your insurance company regardless of an SR-22 filing requirement. The only additional cost to the insured for the SR-22, in Florida, is a $15.00 filing fee. However, drivers who are required to file an SR-22 generally pay more than other drivers for their insurance premium due to the reason for the SR-22, such as, an at fault car accident or a conviction for driving under the influence.

Once mandated by the Bureau of Financial Responsibility to have on file an SR-22, failure to do so may result in your driver license and or vehicle license plate being suspended. Reinstatement of your driver license and or license plate will only occur after certified proof of the required liability insurance in the form of an SR-22 is filed with the Bureau of Financial Responsibility. Reinstatement fees will apply in addition to the $15.00 filing fee. Forms SR-22 and FR-44 are submitted (filed) by the insurance company. The submissions are transmitted electronically and 15 days is the allowable time for the company to file after a policy begins.

If you live and drive in Miami, Florida, you need “Florida Coverage” car insurance. All this really means is that you have to have auto coverage that was issued in the State. You’ll need to have this in place when you go to the DMV to pay for the registration.

Although it is relatively simple to find and secure a car insurance policy, most motorists who live in Miami want to find the cheapest rates possible. Although anyone can find a low rate by only buying minimum coverage, this isn’t going to be enough should you find yourself in an accident.

If you’ve already been in one collision in Florida you may actually have to purchase coverage for bodily injury. This is decided on a case by case basis, but it’s important that motorists shopping for coverage be aware of that fact.

When you do want more coverage than what the law suggests as minimal, consider using these money saving tips:

o	If you only use the car for recreational purposes, tell the car insurance agent this. This often applies to stay-at-home parents as well as the elderly. It costs more to insure a vehicle that is driven back and forth to work each day.

o	Elderly drivers can also take a defensive driving course. Miami is a haven for the retired and many Miami based insurance companies realize that more mature drivers may pose a risk. If those motorists take a defensive driving class to proof they are still competent behind the wheel, they may be eligible for a discount.

Although it can be tedious to call different agents to ask for car insurance quotes the savings you can enjoy will be worth the trouble. Many motorists are shocked when they realize that quotes for the exact same coverage can vary by hundreds and even thousands of dollars a year depending on the company. When you know this, it becomes much less of a task to gather those quotes.
